Are Christmas trees or nativity scenes in public places (city hall, etc.) a violation of the 1st Amendment clause: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof..."?

I'm a hardcore, Laissez-Faire Libertarian and borderline theological apologetic.
Viewing a Nativity scene has as much effect on one's life as my viewing Lady GaGa engaging in essentially ritualistic occultism during her performances. I can change the channel.

The 1st Amendment applies specifically to the federal government. The 2nd Amendments applies to all entities. They were written that way intentionally.

The 1st Amendment says Congress specifically shall make no law establishing or promoting an official religion. While the 2nd Amendment says no one in any way shall impede a citizens right to own and bear (carry) firearms. They are both written in very plain English.

The city and its controlling office is a secular, public institution. Erecting ANY kind of religious display can be seen as amounting to an endorsement of one religious group over another or even imposing a religion upon an unwilling public. Just lose it. It serves no purpose

According to this original intent, a manger scene or menorah on public property would be constitutional. A law requiring there be both if there is one, would be unconstitutional.

"Congress shall make no law respecting an establishment of religion." This simply means congress cannot make laws about religion. This clause from 1A has been stretched and distorted to nearly the reverse of original intent.

To be fair, in civil law; 'commandments' 5 through 10 are nearly universally accepted among most of the world's religions and philosophies as being beneficial to societal good.
No 6, 8, and 9 especially are what US law was based on

I believe in God. But I don't believe in this. It's a religious statement on public property- the property of ALL taxpayers. If not one single person objects to it, then you can keep it. If someone does, then chuck it. It advances no purpose. This is EVERYONE'S America, not just religious America

Having the right to display is free speech. Please note that "Congress" made no law requiring the display. However, "congress" is also precluded from making a law in prohibition. If it is desirable by the majority of people in a community, they should be able to express themselves.

It's not a violation as long as they don't make it a law. The constitution prohibits laws regarding religion. Simply setting up a tree or nativity scene is not making a law regarding religion. And for all of you out there against a nativity scene, way to be tolerant!

Government sanctioned religion is against the constitution. The act if a government building choosing to have a nativity scene is endorsing the Christian religion above all others. Not to mention freedom FROM religion.
