Are Christmas trees or nativity scenes in public places (city hall, etc.) a violation of the 1st Amendment clause: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof..."?

Praet ... You know that the Communist would be respected if they showed up at a Tea Party rally. You also know that if a Capitalist showed up to an Occupy mob, that they'd be raped.

Your double standard and bias is showing.

Praet ... So, you're willing to limit free speech at football games? Maybe it isn't intelligent, but you should be able to root for the opposing team anywhere.

Yelling fire in the darkened theater is a reasonable limit to free speech. It's past time to ignore the idiotic progressive PC police.

Praet ... isn't it interesting that you want to wax philosophical when it comes to limits on free speech from the progressives. If the tables were turned you'd be all over the specifics.

I agree with limits to free speech, but why is this ok? Even if your not Christian, you should despise this!

Pdrome ... once again your hypocritical sophomoric response doesn't surprise anyone.

If the school had said that they couldn't sell Gay Trees, you'd have been all over them for squashing the poor defenseless students' rights.

Wonder what would happen if you root for communism at a tea party convention? What would happen if you exercise free speech rooting for your football team while in the midst of the opposing team's fanblock? Good luck :)

While I deplore this, I doubt limitations of free speech are confined to one side.
There IS NO such thing as completely free speech - you may say what you want but might face serious resistance if you are not pc within the context.

*Tear!!!*

Did that hurt their feelings? Were they crushed?? Lemme guess, it "ruined Christmas"! :'(

Give me a break. There are loopholes for that, like selling them outside of school functions. Besides, I believe this college was being overly cautious.

For those clueless progressives, ask the students at Western Piedmont Community College in California about Christmas. They were TOLD that their college club COULD NOT use the word Christmas in advertising their Christmas trees for sale.

To progressives, free speech isn't so free.

mclainer, I don't believe Jesus is my personal saviour, he MAY have existed, but I celebrate Christmas every year and will continue to do so as, to me, it is a celebration of family, generosity and good will to ALL people!!! Merry Christmas!

I guess belligerent atheism is simply teen rebellion - I've been through that phase when I was in my late teens rebelling against the older generation's values.Life experience mellowed me out - though I have to remind myself now and then not to confuse childish with young at heart ;)

This is in regards to a law, not lawn decor. Putting a nativity scene isn't a law nor excessive entanglement.

Yeah, because when you atheists go to a mall and see a tree with tinsel on it, you feel the need to cover your child's eyes and hurriedly run far from the building.

County of Allegheny v ACLU; McCreary County v ACLU; Lemon v Kurtzman-- there are plenty of documents. The 1st amendment also says that no law (includes ordinances, motions etc) shall RESPECT ANY religious institutions.. You saying it isn't so over and over doesn't make it so

A belief maybe but not a belief system like a religion - no rituals which are important to religion, no worshipping.

No where in any document does it state that the separation of church and state does not Allow free expression of religion anywhere. It merely states that government will not interfere with exercising religion. I don't believe that you can say that by having a Christmas tree or menorah on public

@Palindrome.... I never said this country was founded on Christianity. This country was founded on freedom religion whatever it is. If some of the Founding Fathers happen to be Christian, Jewish, Atheist I really don't care. I was just posting the entire quote. It changes the meaning.

Were the founding fathers inspired by Christian ideals, morals and ethics? Probably! Just as much as nature inspirers the painter! Being inspired, even influenced by your religious beliefs DOES NOT equal founding a religious state or founding a state that is in some form or another religiously based

at the end of the day, the only thing this country was really founded on were the ideas of MEN: Hobbes, Locke, Aquinas, Jefferson. Their ideas and beliefs about a Creator that endowed us with FREE WILL is what founded this country- FREE WILL, not a church. Not any particular religion. Ideas of MEN
