Are Christmas trees or nativity scenes in public places (city hall, etc.) a violation of the 1st Amendment clause: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof..."?

Well, I'm not a Christian, but I think it's pretty clear that Jesus was born! Sure, it's a historical event. On the other hand, in context, nativity scenes are not really intended as history lessons.

I will also add that if Muslims and devil worshippers want to display their fictional stories like the Christians then they should also be allowed too.

No, people have the right to believe in myths and they also have the right to display those myths. If people want to display make believe figures from fictional stories that's their right.

right near my town hall there's a big nativity scene and a menorah. I'm agnostic, and the first thing I said was, "How tacky" because it was huge and ugly. I like the fact people are finally recognizing Chanukah.

Freaks out? I think not. I will sometimes partake in typical 'Christian' activities not because I believe, but out of respect for the person. Just like going to other countries and not doing a thumbs up, or eating with my left hand.

I think the "christmas" tree has lost it's traditional significance. So technically it is. But yet again the US is a Christian nation.

As someone who is agnostic it disturbs me that ppl actually protest these things. These are long standing practices that should be left alone. Censoring religion violates the constitution and freedom of speech. We have a nativity scene on the town common with a menorah by it. Neither offends me.

I agree. But I wouldn't put Christmas trees under the "religious" umbrella. Trees are more commercial these days. Nativity scenes are a different story. Not only do they scream religion, they borderline on scary/creepy.

If you need a government to endorse your religion, you have a crappy religion. The government workers can display whatever they want at home, but the public places are not theirs. Be respectful to other people.

I don't see the scene of a bunch of homeless folks hanging out in a barn as overtly religious, and the Christmas tree certainly isn't, so either of these seems reasonable to me. But a cross with a dead Jesus hanging from it or other religious symbols or signs don't belong in publicly owned places.

Exactly, even though Christmas has been watered down to just a day for family gathering and gift exchange, that doesn't make the holiday have any less of a strong Christian essence.

They can't even survive the most minimal level of judicial scrutiny: does it advance a state interest? NO
