A mother who is NOT a USA citizen intentionally flies here when she is 8.5 months pregnant. Gives birth to the child in the USA. Then flies back home with a baby who is one week old. Do you support giving citizenship to this new born child?

It’s what the constitution says. I worked for the government for 26 years and swore an oath to uphold the constitution. I don’t recall ever rescinding that oath. I support all of the provisions of the constitution, whether I like them or not.

This is not at all what our founders wanted! Back then people couldn’t fly here, have a baby and fly back home. I believe in upholding the constitution too, but let’s understand and protect our country from loopholes created through progress

That’s why there is a process to amend the constitution. It doesn’t mean we can blow off the constitution with an executive order, or even a law. And, FWIW, what you are saying also applies to the 2nd amendment.

How about the Chinese billionaire who has over 100 children from surrogate’s that he paid $200,000 each to have a baby in the states and then come home. Plus. There are thousands of people in China who were born here but moved after they were born. They now vote from China. The 14th amendment wasn’t written for that.

Interesting statement, what makes you think they can't fly?

Let's change the scenario, a woman, 7.5 months pregnant comes to the United States, has the baby, then goes back to her country when the baby is one month old, should that baby have US citizenship?

Birth tourism has been massive out this way for decades now. The Sam Gabriel valley (east of here) is filled with “birth tourists” from China.

Wrong. Educate yourself. There is a whole industry who caters to rich women from around the world. Enormous houses in California that do this that host many pregnant women every week. Look into how many Chinese women do this every year.

If she is a tourist and happens to give birth while in the US, then I think the baby should be able to have the option of dual citizenship.
