A woman falsifies documents to receive food stamps and she is caught. If she is forced to pay back the money it would place her in financial hardship. Should we make her pay it back?

If anything, she should be made to pay it back through community service.

Hell no! Why should anyone be held responsible for a choice they make in this country? From what I understand these SNAP cards are like a credit card and have a balance on them. If she went to our public schools she probably didn't learn math.

Why and what did she falsify? Did she need the food stamps? Was the system faulty in what it asked? Or was she truly being a fraud?

Not if she needed it. It can be frustrating with that big welfare gap. It keeps people on welfare, and makes those that don't qualify do things to get it. Or go without it.

There are very few things that are simply reported on a form, so that's not generally a good excuse. It's case by case - we literally have to research the facts behind EVERY case and make a decision.

What we think does not matter. Government will just take another bite out of your paycheck to cover her. if it goes to court, legal fees and incarceration costs far exceed loss.

Pay it back or go to jail. What if all of her documents are legit but has a boyfriend who moves into her section 8 house with her and he makes $50k per year. She doesn't falsify docs and they are not married. Is she legal?

Yes, even if it takes her the rest of her life to do so. Those who are charged with embezzlement or larceny are generally made to pay restitution as well.

She did the crime, she pays the consequence. If she can't actually hand over the money, she should work at some manual labor until it is paid off.
