Two guys are out on the town smashing pumpkins that they take from random porches. They pick another house and both grab a pumpkin. They find that there were razor blades hidden in them and now need stitches. Who is responsible for paying the bill?

If you smash pumpkins I guess you should take into consideration that some people use pumpkin protection measures. I think the pumpkin guys should pay even though the legal liability may lie with the homeowner.

Semi related... Okay, barely. Road workers were setting up two miles of pylons. Daily someone would drive over them. Two weeks later they filled the tenth one with concrete. I got to see the skid marks and broken glass.

The homeowner has no responsibility to subsidize the vandalism of hooligans, nor to offset the occupational hazards thereof.

The homeowners are responsible legally.
The pumpkin guys deserve it though.

Kermie same way a thief breaking into your house can sue if you shoot and injure them. The same way I can walk across your property and twist my ankle on a hole your dog made and send you the bill. It's your property and you are responsible.

Now I'm not saying I agree with this. I don't agree but legally owning property without force fields can earn you a lawsuit.

Not if you shouldn't be there and don't have permission. Someplace reasonable, like my sidewalk, okay. But my porch and my pumpkins that you have no reason to touch, no, I don't believe I would be legally responsible.

I know it's an old law but in many states it hasn't been revised so it still stands.

Thanks. That's kind of messed up. I suppose it would be foreseeable that someone could cut themselves on the pumpkin since that was the whole point of it...

The pumpkin is the homeowners private property. The vandals shouLd have to pay the bill.
