As Speaker, I gladly support this bill. I emphasize that the Associate Justice would only be used if a regular Justice is recused. Also, the Associate Justice will require Congressional approval. I urge my colleagues on both sides to pass this bill.

Pretty interesting little conversation. You would hope to avoid partisan decision by the court because of political motivated position of a VP.

A MOTION HAS BEEN BROUGHT TO THE FLOOR BY CONGRESSMAN SKINNER (R) OF MASSACHUSETTS TO MAKE THIS BILL A CONSTITUTIONAL AMENDMENT. THAT VOTE WILL NOW BE BROUGHT TO THE FLOOR.

The Vice President should not have the power to break the tie. I view this as an infringement upon the Separate Powers Compromise.

I don't think this new position has the authority either.

I say let the justices do their job

Let the justices do their job.

Voting for this does three things.
1. Unnecessarily adds another government position.
2. Takes power away from VP
3. Takes power away from the justices by having a new position with as much say as them.
VOTE NO

here is my response
1. I feel this is a needed position it allows the court to undergo its normal operarions should a judge recuse themselves
2. The VPs power is to vote in the case of a tie and they still have that power

3. the justices have just as much power as before they just have another justice step in when one recuses themselves

With all due respect mr. President, I am even more confused. Will the substitute justice and VP vote in the case of a tie. Lol

The associate justice will only vote if a Justice has to be recused

zman117 Ohio

I do not like this. We already have five justices, there can't be a tie. In the rare event there is we have the VP with the power to break a tie.

We do not need another position like this, efficient government can be accomplished already.

How is the new position a violation of the Separate Powers Compromise? The new position would be in the SCOSOH Committee and only in the SCOSOH Committee.

Plus, the VP's vote breaks up the tie. The VP is a wasteful job without that role.

zman117 Ohio
10/14/13 5:27 pm

If it is in fact a tie or the Supreme Court ever does not reach a verdict, I think it should be exactly like in real life. It simply goes back down. Which in this case means that if it is a bill then whatever congress has decided.

Zman is becoming conservative, and also what if they don't come to a decision? Who are the justices (Zman, Political, AFlay...

Sorry not AFLY and VP has announced he may not be able to perform his duties fully

zman117 Ohio
10/14/13 5:30 pm

I saw him say he can, he just is not running for a second term.

Like I said, we rarely have the chance for a tie. If this happens then the justices need to put on their grown up pants and figure it out. JUST LIKE IN REAL LIFE

political Georgia
10/14/13 5:31 pm

Well, we have 5 reliable justices. If we have an incompetent VP, there are other ways around having an efficient government besides changing the law to avoid this unfortunate scenario.

zman117 Ohio
10/14/13 5:31 pm

If they cannot, then maybe we have a larger problem on our hands?

Not to mention, worse case scenario is that the court cannot reach a decision. It isn't the end of the world.

Can I ask current SC justices opinions?

As a congressman I opposed this legislation. From a Constitutional standpoint, it is hard to prove this bill unconstitutional as I currently see it because the Constitution briefly mentions a Supreme Court of the land. I am interested to see what

It is currently not a constitutional amendment

Currently we are relying on a constant presence by the VP to settle ties in Supreme Court votes

our justices are active congressmen amd propose a lot of legislation we need a way to let the court do its job effectively

Which Supreme Court was a tie? I thought everything was running pretty smoothly. For the most part justices have been very active.

10/14/13 5:18 pm

this is for when justices recuse themselves as in when we only have 4

the VP casts a vote if it is a tie when the court case expires

political Georgia

That is what I thought. Is there a problem with that procedure? The VP does not have much of a role anyway. It would seem the VP is already the rescue judge as the current system is.
