I’m fully with makem here. The attorney general has to follow the law and federal law still prohibits marijuana and any related products. We cannot have the government selectively enforcing the law. The problem here is the law and congress has to change the law. For the record I’m for full legalization and believe this girl (with doctor and parents guidance) should have access to this treatment if it helps her.

That is the most ridiculous sentence I have read in months.
It took about 5 minutes on jewgle to discover that a 12 year old isn’t even old enough to sue anyone by herself in the state of Colorado. Or consent to being treated with weed oil, for that matter.

Oh please. This is so ridiculous. There are other treatments out there besides one that is federally prohibited. The plaintiff shouldn't get so much extra support just because she's a 12 year old girl. The lengths the weed lobby will go through to maximize their profits is disgusting. The federal government is totally within its rights to prohibit an interstate product like marijuana and the DEA should enforce the law in all 50 states.

Marijuana costs way less than the other treatments, is the most successful of all treatments, and has the fewest dangerous side effects. So unless you’d like to pay for this girl to get an expensive treatment that may or may not work while having potentially fatal side effects, she should get the marijuana.

Same. I have ehlers danlos which causes lots of pain. Drs wont ever give opiates, but no one is looking for alternatives. Weed doesnt help as much but its something. Medical would be great so you can pick optimal stuff for your issue. Same with insurance not covering massage etc...stuff that helps me without opiate risks.

It's not explicitly a federal power. I just finished rereading the entire US Constitution and I can say that much for certain. Under Article 1 section 8, it is not unreasonable to believe that Congress can restict marijuana if THEY BELIEVE it to be harmful to the "general welfare" of the United States. Having your citizens potentially die from a substance would give them plenty of justification to enact laws restricting said substances. Congress has the power to pass laws that are "necessary and proper" in the pursuit of protecting our general welfare. Let me reiterate that this it up to Congress to decide. If they can make a case for prohibiting marijuana, in any form, then they have the power to do so. Now, Congress could be full of Crap and are making up claims to support an agenda, but that is irrelevant in this context. the only thing of relevance is the argument they present and how reasonable it is.

Those commenting on a 12 year old using cannabis, pause for a minute and think of the medications (especially psychotropics that get prescribed to millions of children. Many of those aren’t good for development. Most have some moderate and long term consequences but get prescribed because the benefits outweigh those effects. Cannabis is minimal compared to what pharma has on the market. Read about your meds.

I honestly can't make a good case for her. She has to show that the law is unconstitutional. The burden of proof is on her and her family (and the lawyers the family hired) to provide the evidence and prove that it is unconventional to make laws banning marijuana. I don't think they have much of a chance at winning against sessions

As terrible as it sounds, we should be debating whether the girl has a viable legal case. We should not be concerned with the well being of the girl in terms of the debate. If it'd kill her to lose the court case then she dies. I don't believe that a clear look at the debate can be had without that separation.
