Does lack of action imply consent? This is not specifically in reference to sexual activity, but to any behavior.

No. Lack of action implies just one thing: lack of action. It is never tacit approval, but may be disapproval that they haven't yet had the time or energy to express. If approval is necessary or appropriate, get it, explicitly. To do otherwise is either arrogant or rude. Or both.

Yes, for example a person can be too scared to resist but still doesn't consent.
