If I opened items at a gas station and left without paying, would it be theft?

Depends on the item. gas stations sometimes sell basic tools, so you might open the box it's in then discover its the wrong tool. If you put it back in the box it can still be sold so its not theft.

On the other part if I opened Oreos for no famed reason and left without paying. I'm stealing in a seance. Because they can't be sold.

Lets say I opened a bag of chips and find bugs in it. It happens :). I'm not paying for that!!

It's theft, especially if its a perishable item.

How do I sell the product?
How do I recoup the loss?
This act negatively impacts the profitability piece of the business.
Vandalism, in most cases, is covered by insurance. (Broken windows, spay paint etc) However, customer ignorance is not.

Well, the second question is usually intended to test people's answer to the first one.
If they answer the same to both, then there is consistency and (some sort of) reasoning to their answer.
