Exonerated/Franklin/rape/timed served: 21 yrs/cause: perjury. This was a police officer. The victim, 13yo, recanted saying she made up story. She was sexually active & was being abused by step-father. Should we charge (now 30yo) woman for perjury?

I lean no. Statute of limitation alone. If the girl was being sexually abused, highly likely that she was physically abused and most certainly mentally abused. I know what it's like to be totally terrified. I'm quite sure if she told the truth there and then horrible consequences I don't know how much a state would've protected that child. Quite often when girls that age come forward the mothers blame them also. I think she owes him a very sincere apology if he is willing to accept it.

What a terribly sad situation. Both of them suffered so unnecessarily. I think the real abuser needs to be held accountable for his role.

She was 13. A minor and the statute of limitations would be up for lying under oath but there should be something happen.

No, but she should have to compensate him. SUBSTANTIALLY.

Of course! If the statute of limitations isn't up yet! Because of that lie an innocent man lost a giant part of his life for something he didn't do!

The federal statute of limitations for perjury is five years (18 U.S.C. § 3282)

But at the time of the crime she was a child. Her crime was a teenager lying, backed up by a cop... prosecute the cop?

In Kansas it is just 1 year.
Ridiculous.
