For those watching the Zimmerman trial: Has the prosecution met the burden of proof, that GZ committed 2nd degree murder?
I would ask " How can they prove something that isn't true?" But that would be naive .
Yes it would.
No, the prosecution had some serious blunders
I'm not sure what it is they are trying to prove. Is it that GZ intended to kill him before the altercation?
Prove it wasn't selfdefense. Yeah same thing I suppose.
Not premeditation that would be 1st degree murder. 2nd degree requires anger or malice and is considered a crime of passion. You made me angry in the moment I'm going to kill you kind of thing.
So they are trying to prove he acted out of anger rather than self-defense. I think it is close. They have evidence of him lying and of calling him an A-hole before even meeting him, but I don't think they did a great job of emphasizing that.
I said anger as an example. But more along the lines of proving a crime of passion.
The bystander 911 call is key. The screams were before the gunshots. Prosecution witness testified GZ was on the ground TM on top of GZ. Before gunshots.
He did say in his call to police dispatch. "These a**holes always get away" and "f'ing punks", Very calmly more so frustrated or annoyed. But he spoke very generally.
On could infer GZ believe TM was getting ready to commit a crime.
At the end of the day a 17yr old is dead too early. But GZ acted in self defense.
Prove that he was defending himself and that Travon Martin was not as well.
Burden of proof is not on the defense. The defense doesn't need to prove GZ acted in self defense. Just that GZ is not guilty of 2nd degree murder beyond a reasonable doubt.
If he is found not guilty that means GZ acted in self-defense.
Rev you don't get it if they can't prove GZ was defending himself the evidence insinuates that he had ill will and spite.
Where is your proof of ill-will?
The comparison of GZ actions in this 911 call compared to the actions on his prior 911 calls along with his tone wile making the call
I've been following, no, he is not guilty as charged. The prosecution has not met the burden of proof.
The prosecution did not do their job.
They really didn't. They did a very poor job
Same with Casey Anthony it's a tough job. Their witnesses really helped crest doubt. I don't have a dog in this fight I wish trayvon had never been shot but justice must prevail.
When responding I only want your opinion on the case the prosecution has made. Not your own opinion of what happened that night.
Simply did the prosecution do their job.
Before the verdict comes back ill ask if the defense proved that there is reasonable doubt that George did commit 2nd degree murder.
I think it may turn to just man slaughter
I'm not sure if the jury can change the charge from 2nd degree murder to manslaughter.
I watch the news, they said in Florida they can supposedly
Ok you may be right I just don't know. If you can find the source that would be helpful.
Ok. I will try. I just remember on Fox News the ppl on their panel can change it in the state of Florida I'm pretty sure.
