Obviously yeah it's a tax but its troubling to think what they could use that ruling to justify now.

I think it was in the affirmative action case where one said something like it isn't as necessary today as it was 30 years ago and therefore they struck it down... I was like... Uh what about the constitutional changes...

I can't remember exactly what case it was but the point one judge made that it changes with time stuck out in my mind.

I sometimes think that lately, some of these Justices have some skeletons in their closets and the Obama Administration found them. Especially Justice Kennedy. They have just recently become obviously political.

They are worthless. Ones who are suppose to uphold the law are instead have more interest in protecting and upholding themselves in the court

Read The Federalist Papers. It'll explain what the 10th Amendment means, what the scope of federal power is, and most importantly, what the interstate commerce clause is all about.

What's really surprising though is the ACA wasn't upheld under the commerce clause. It was upheld under the taxation powers. Still ......

Maybe you should start with justice Scalia's dissent, then move to the Federalist. Although, the dissent would make more sense if you read the Federalist first.

If you really want an education, also read the "anti-federalist papers."

@ okie exactly...they say its wrong for the gov to tell us what to do within this law yet they uphold it through taxation. I mean it's kinda confusing but I know that it's wrong

The "individual mandate" was upheld as a tax. I believe the rest is interstate commerce clause.

Migrating bird regulations are enforced via the interstate commerce clause.
