A man and woman who are drunk have sex. While both were intoxicated and legally unable to consent, who is more likely to be charged with rape?

A friend of mine was passed out drunk when he was raped by a girl who was trying to get pregnant. He now has full custody of the resultant child, but she has no official criminal charges.

women are capable of rape, but sadly the justice system doesn't think so. luckily in the case of this question, unless either decides to press charges then there are no issues.

The only time I've ever heard a woman getting charged with rape is if it's with a student and even that seems to be a stretch for courts

The man. Its sad too. If a woman gets drunk and gets behind the wheel she is responsible for her actions. But if she gets drunk and has sex then all of a sudden she is a victim. Serious double standards.

Do they ever charge women? I've never heard of it if they. I'm also not sure what the statutes say. I thought you might know.
