Jill's friend Paul has had a crush on her for years. One day she says "the only way you can prove you love me is kill my husband." He is later arrested for the murder, tells the story, and she admits to saying it. Should she be charged with anything?

If she didn't present any sort of contract for him to sign, then no this is not like her hiring a hitman. There would likely have to be some substantial evidence of her taking some part in the planning of the murder for any conspiracy charge to stick.

Agree, manipulating his weakness to accomplish her crime seems like conspiracy to me. Hope he got some before he got caught.

No, that isn't a contract for a hit, or even much of a hint. At most it's a way of saying get over it and move on, because as long as my husband is alive I'm taken. She's totally in the clear, and the guy is a dumbass.

My assumption is that her statement was casual without any real intent. Maybe I'm wrong.

Yeah. It would be different if she felt or knew he would do it. To me it sounds like she said it kind of in an inappropriate screwing around way.

I noticed you were careful with your wording - too careful. However, I'd charge her with conspiracy and accomplice before the fact anyway to see what happens. It could be that Paul is feeble minded and she is super smart and there might be a conviction in there somewhere. Paul's interpretation of what she did say and other evidence could provide context that you didn't. :)

After this episode, she found out what he was doing with the bar fliers to AA patrons and wants nothing to do with him. It's sad
