If a company loses a lawsuit, should the losing company be required by law to pay for the winning company's legal bills?

In some cases, yes. Especially if it's a nuisance suit.

As a small business owner you can get sued very easily. I'm all for the added fee of paying court costs. I haven't lost a case yet.

If...Company A (Goliath) brings the suit against Company B (David), and then Company A loses, then I think the judge should strongly consider charging defense costs to Company A.

If Company A (Goliath) brings the lawsuit against Company B (David) and Company A wins, I don't think it should be a forgone conclusion.

I think we want to deter frivolous suits and tying up court time without discouraging due process for the company with lesser means.

As much as I like the idea, I have to say no. I'd be more agreeable with some type of flat fee thats paid by the loser to help pay for legal fees and only from the plaintiff to defendant, not the other way around. Some lawyers are unaffordable.

No. Company A (small/medium) sues Company B (big) in a lawsuit they know they will lose. Company A loses and racks up large legal costs passing them onto Company B. Company A isn't looking to make money on the results but is instead looking to hurt Company B by having them spend their money and resources on both side's legal fees.

In case someone stupid decides to file a lawsuit beyond their means- they should have the option to pay or spend time in jail or on probation.
