If a company loses a lawsuit, should the losing company be required by law to pay for the winning company's legal bills?
In some cases, yes. Especially if it's a nuisance suit.
As a small business owner you can get sued very easily. I'm all for the added fee of paying court costs. I haven't lost a case yet.
It should be part of medical malpractice lawsuits...
And it should be the plaintiffs lawyer having to pay it if they lose...
If...Company A (Goliath) brings the suit against Company B (David), and then Company A loses, then I think the judge should strongly consider charging defense costs to Company A.
If Company A (Goliath) brings the lawsuit against Company B (David) and Company A wins, I don't think it should be a forgone conclusion.
I think we want to deter frivolous suits and tying up court time without discouraging due process for the company with lesser means.
Yes, but not more than they paid for their own legal fees.
As much as I like the idea, I have to say no. I'd be more agreeable with some type of flat fee thats paid by the loser to help pay for legal fees and only from the plaintiff to defendant, not the other way around. Some lawyers are unaffordable.
Like in other countries.
If its part of the judgement...
No to companies but yes to individuals.
No. It seems to me that it would encourage frivolous lawsuits
Most people say it would discourage frivolous lawsuits
People too. Don't sue me for so ething stupid and make me pay for lawyer bills.
I said yes, but I think they should only have to pay if their case was unreasonable.
Is the requirement for individuals - if so same for companies. Lol.
I just said companies because when I broaden the question the focus is more scattered.
Only if the companies are family equal in size and value.
No. Company A (small/medium) sues Company B (big) in a lawsuit they know they will lose. Company A loses and racks up large legal costs passing them onto Company B. Company A isn't looking to make money on the results but is instead looking to hurt Company B by having them spend their money and resources on both side's legal fees.
I'd say no, but the company is always free to sue for damages + legal fees on their own
Yes. It would cut back on the legalized extortion.
Because an individual may not be able to afford it.
Then an individual ought to reconsider nonsense or frivolous law suits, shouldn't they?
Fair enough, but we should have a backup system just in case.
Senate ... why is a backup required?
In case someone stupid decides to file a lawsuit beyond their means- they should have the option to pay or spend time in jail or on probation.
Senate ... you gave several options -- that I agree with -- but all of them fall under the notion of loser in frivolous lawsuits "pay"!
Yes, specially if the defense wins to avoid so many frivolous lawsuits.
