You can write a law in a manner such that its application is unavoidably inequitable and yet still apply it to everyone equally. There's a famous Anatole France quote speaking to this juxtaposition of formal and substantive equality:
"The law, in its majestic equality, forbids the rich as well as the poor to sleep under bridges, to beg in the streets, and to steal bread."
Laws that pretend everyone has the same opportunities in life can cause just as much substantive inequality
as can laws that explicitly discriminate against certain groups of people.
So my point was that a more realistic approach to substantive equality may very well involve treating different groups of people differently. Like retirees or vets.
