By the 4th Amendment, police officers require a warrant to search private property. A warrant is not necessary if consent is given to search. However, unlike with the 5th Amendment, the suspect need not be told they have a right to refuse. Fair?

It's fair. Folks should read up on their rights before getting in trouble. Ignorance doesn't give a person a pass.
