Should people get a DUI even if they haven't killed anybody or caused damage of any kind? (What I mean is they left the bar drunk, got in the car and drove home and got home. No innocents were hurt.)

I take great care to not drive drunk because it's dangerous. I make alternative arrangements beforehand. That's responsibility.

Ummmm...yea. That would be the definition of *Driving* Under the Influence (DUI). Collateral damage would be a whole nuther set of charges.

No legal proof of the level of intoxication. As much as I hate drunk drivers I still believe innocent until proven guilty.

Esha, Who gets into a car, drives home drunk, does not get pulled over, and still gets tested? I am not understanding what you're saying.

Maybe not fix stupid but reduce it for sure. I friend of mine got a DUI & had to pay big bucks, he told everyone he knew and awareness towards drinking and driving spread at a personal level.

I would agree that drinking and driving is a terrible combination because it could lead to disastrous results, but I don't think we should make victimless situations crimes.

Well most DUI's filed are ones which cause no physical harm to people or property. Giving a penalty to those who drive above the legal limit will discourage others do to so bc they will serve as an example of the consequences that can be faced.

They are also breaking the law by having their BAC above legal limits.

We already give a fine or penalty to people who drive over the speed limit and yet people drive over the speed limit. You're not gonna fix stupid through government regulation.
