If you prioritize some of the more controversial policies that have been passed during his tenure like the NDAA section 1021 and the Patriot Act in combination with his record as the least transparent president in history then one can argue he is.

No, Rot I'm afraid that's not how transparency is judged. A large part of transparency is based on the amount of censored government files or outright denied access under the Freedom of Information Act, and that reached an all time high last year.
