Inspired by rotavele (who you should follow). The owner of a baseball team, in an effort to show support for cross dressing, orders her team to play the remainder of the season in skirts or be banned. Should she be legally allowed to give the order?
Let's assume the league doesn't care. Yes, it should be legal. They are all under contract with her. Employers have the right to alter the employee uniforms as they wish.
Legally? Maybe, as many businesses have uniforms and dress codes. Being involved in a collaborative enterprise with other teams/owners, and that leagues usually have a CBA that addresses such things as uniforms and approved punishments, maybe not...
Can the game be played as well wearing skirts? I guess they do allow for a greater range of movement, although less protection for the players' legs. It'd depend a lot on how the rule was laid down I think. If she's doing it out of support for
"cross dressers" I'm honestly not sure what she means. Cross dressing as I understand it is more of a fetishize than a lifestyle or identity. Not to mention, showing support for people in marginalized groups generally doesn't involve imitating them.
It seems there is also the possibility that it could be perceived as harassment by some players, and/or as inviting harassment. The more I think about it, the more I think this should not/would not be legal for an employer to require.
Can she legally? Maybe. It depends on what's in the contract.
Should she? I don't think so. While I personally have nothing against men wearing skirts, I think the law should better protect employees from employer whims all around.
As ridiculous as it is she is the owner of the team and as such I think she has that power. Especially if something like uniforms are covered in their contract. Although, I'm sure they weren't thinking skirts were going to be an issue...
