You're the HR manager of a mid sized IT consultant firm. A few of the employees hired a guy in a gorilla costume to sing and grind on you during the sensitivity training you routinely teach. You know the guys responsible for it, do you turn them in?

No but I also would not submit to the costumed person's attentions. If that person did not get it he would get carted off in a police car for assault.

At work you don't have complete free speech. Your employer can decide they want a safe environment for everyone and take action if you make it feel unsafe for someone. Is it violating free speech to discipline someone for harassment?

And @justbob- it would depend on their past. If they were new or had been a problem in the past I'd definitely fire them. An older employee who's never harassed anyone had been a good employee otherwise? I'd discipline but not fire.

Because when you're new and don't have a positive record to back you up should be a little more careful with things you know could be construed as disrespectful. I'd be still figuring out what I thought of you as an employee.

@eggslayer- we need it for issues like workplace harassment, sexual harassment. I know this isn't the focus in all sensitivity training, but it's necessary.

Aj, aside from being necessary, is it effective? In my experience, the threat of a three hour lecture acts more as a deterrent to saying anything that might be construed as offensive to anyone, than it does as an instruction method.

@egg- unfortunately, we can't rely on parents. And considering how difficult actual harassment is to prove, I think it's a little dramatic to use shoe complimenting as an example.

I'm not really onto gorillas, but I'm not clear on what the offense would be. I get that having a stripper do his or her thing at work might annoy a few these days, even on a birthday, but what would be the complaint when it's a gorilla? No.

Perfect. This is what you are being paid to do.

A close analogy would be a safety manager observing an unsafe act and doing nothing. In both cases, you can be held personally liable in court should it come to that.

Yes! This happened. The guys hires a stripper to entertain the site director on his birthday on premises. Nobody said anything but the video got out. Suspensions w/o pay all around!

the fact that they did it during the sensitivity training would be the thing that would get them in trouble for me. at work there's a time to have fun, sensitivity training isn't one of those times

If I'm the HR manager, the I set the bar for the corporate culture on this sort of thing. I get the joke, but I'd have to turn them in or run the risk of some actually harassed employee thinking I don't take harassment seriously.
