Dealer sells heroin to Bob, & advises Bob to only take 1/2 of it at a time. Bob takes the whole amount at once, OD's and dies. Should dealer be held responsible for Bob's death since he provides the drugs & be punished by law?
Dr gives you Rx, filled by pharmacist, both of whom are very clear about how controlled drug should be taken. Additionally, it is clearly written on bottle. Jack takes entire bottle w/alcohol; dies. Who's @ fault? Jack. Same thing. Same answer.
Thats the thing about drugs. Once you're under the influence, your decision making skills go down the drain.
Im undecided. The dealer should be arrested for selling illegal drugs. Not someone else's bad decision.
There were reliable witnesses to the sale, warning, and consumption of the drugs? Not heroin addicts themselves? And did they try to stop Bob from cooking and shooting the whole amount? These are crucial questions that would have to be answered...

Prescription drugs are just as dangerous as illegal or OTC drugs.
I'm seeing below that a dealer would be charged but I don't think he should be, just like a doctor is not held legally liable for a prescription overdose. The dealer needs to be charged for selling the drugs but taking to much is on the user.
